Terms of Service

1. Acceptance of Terms

By creating an account, placing an order, listing a business, or accepting a delivery on Cater Market, you agree to these Terms of Service and acknowledge the Privacy Policy. If you do not agree, do not use the platform. Cater Market is operated as a marketplace that connects customers with independent restaurants, caterers, and delivery providers.

2. Eligibility

You must be at least 18 years old and able to form a legally binding contract to use Cater Market. By registering, you confirm that the information you provide is accurate and that you are authorized to act on behalf of any business you represent.

3. Your Account

You are responsible for safeguarding your account credentials and for all activity under your account. Notify us immediately of any unauthorized use. Cater Market never stores your password in plain text and uses industry-standard secure password hashing. See Account Security for details.

4. Customer Responsibilities

Customers agree to provide accurate event and delivery details, to be reachable for coordination, and to pay the total amount shown at checkout including applicable taxes, service fees, and delivery fees. Customers may not abuse promotions, submit fraudulent refund requests, or harass caterers or drivers.

5. Caterer & Restaurant Responsibilities

Partner businesses are responsible for menu accuracy, pricing accuracy, food preparation, food safety, safe packaging, accurate allergen and dietary information, order fulfillment, maintaining required licenses and permits, and honoring the cancellation terms they publish. Partners must cooperate in good faith with refund and dispute resolution.

6. Driver Responsibilities

Delivery partners are responsible for safe, timely delivery, accurate pickup and drop-off, vehicle suitability, and complying with all applicable driving and insurance laws. Drivers must not retain customer personal information beyond what is required to complete the delivery.

7. Orders & Cancellations

Each order is a contract between you and the caterer, facilitated by Cater Market. Cancellation and refund rights depend on the caterer policy displayed at checkout and the timing of your request. Preparation timelines are system-managed and shown before payment.

8. Payments

Payments are processed securely by our payment provider. Cater Market never stores full card numbers, CVV codes, or Apple Pay or PayPal credentials. Charges are tokenized and verified server-side. Idempotency protection prevents duplicate charges.

9. Platform Fees

Cater Market charges a service fee to customers and a commission to partner businesses as disclosed at checkout and in your dashboard. Fees may change with notice.

10. Prohibited Conduct

You may not use Cater Market to sell unsafe or illegal items, misrepresent a business, evade fees, circumvent the platform to avoid protections, scrape data, or interfere with the service. Violations may result in suspension without refund.

11. Disclaimers

Cater Market is a marketplace facilitator. We do not prepare food or deliver it ourselves. Caterers are independent businesses responsible for the quality and safety of their food. Drivers are independent contractors. We are not liable for the acts of independent parties beyond what is required by law.

12. Limitation of Liability

To the maximum extent permitted by law, Cater Market is not liable for indirect, incidental, or consequential damages arising from your use of the platform. Our aggregate liability is limited to the amount you paid through the platform in the preceding 12 months in connection with the relevant order.

13. Changes to These Terms

We may update these Terms. Material changes will prompt a renewed acceptance. Continued use after the effective date constitutes acceptance of the updated Terms.

14. Termination

We may suspend or terminate accounts that violate these Terms or for legal, security, or fraud reasons. You may close your account at any time from Settings. Certain records may be retained as required by law or for fraud, tax, and dispute prevention.

15. Governing Law

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict-of-law principles. Disputes will be resolved in the courts of Ontario where permitted.
